What is FAPE (free appropriate public education)?
FAPE, free appropriate public education, is the right of every eligible child with a disability in the US to special education and related services at public expense, under public supervision, meeting state standards and provided through an IEP. It is guaranteed by IDEA and also by Section 504. 'Appropriate' means designed to let the child make meaningful progress, not the best possible education.
What this means in practice
FAPE is the foundation of US special education. In 2017, the Supreme Court's Endrew F. decision clarified that an IEP must be reasonably calculated to enable a child to make progress appropriate in light of the child's circumstances, raising the bar above minimal progress.
What FAPE includes
- Special education designed for the child's needs.
- Related services such as speech therapy, occupational therapy, counseling and transportation.
- Supplementary aids and services in general classes.

What FAPE does not mean

India's RTE Act and RPwD Act guarantee free education for children with disabilities, the Philippines' RA 11650 guarantees free public basic education for learners with disabilities, and Nigeria's disability discrimination act, signed in 2019, provides for free education up to secondary level.
